Welcome to High St. “We,” “us,” and “our” refer to High St. These Terms, together with our Privacy Policy and Refund Policy, govern your use of our store and website (the “Services”), which are powered by Shopify. Please read them carefully — they include warranty disclaimers and limitations of liability. By using the Services, you agree to these Terms. If you don’t agree, please don’t use the Services.

1.  Eligibility & accounts.  By using the Services, you represent that you are the age of majority in your state, or that you have a parent’s or guardian’s consent. You’re responsible for the accuracy of the information you provide and for keeping your account credentials secure. You may not transfer or sell your account.

2.  Our products.  We work hard to represent our products accurately, but colors and appearance may vary depending on your device. We don’t warrant that products will match your expectations exactly. Descriptions and availability may change at any time, and we may discontinue products or limit quantities at our discretion.

3.  Orders.  Placing an order is an offer to purchase. We may accept or decline any order at our discretion, and your order isn’t accepted until we confirm it and process payment. Please review your order carefully — we may be unable to change or cancel it once accepted. Purchases are for personal or household use, not resale or export.

4.  Prices & billing.  Prices, discounts, and promotions may change without notice. The price charged is the price in effect when you place your order, as shown in your confirmation. Posted prices exclude taxes, shipping, and handling unless stated. You represent that your payment information is accurate, that you’re authorized to use it, and that you’ll pay all charges at posted prices.

5.  Shipping & delivery.  Delivery times are estimates only and aren’t guaranteed. We aren’t responsible for delays caused by carriers, customs, or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you. See our Shipping Policy for details.

6.  Intellectual property.  The Services — including all trademarks, text, images, graphics, video, and their arrangement — are owned by High St. or its licensors and protected by intellectual property laws. You may use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, or republish any material without our written consent. “High St.” and our logos are our trademarks; “Shopify” and its marks belong to Shopify.

7.  Third-party links & tools.  The Services may link to or include tools from third parties we don’t control. These are provided “as is” without warranties, and we’re not liable for them. Review any third party’s terms and policies before using them.

8.  Relationship with Shopify.  High St. is powered by Shopify, which enables us to provide the Services. Any purchases you make are made directly with High St. You acknowledge that Shopify is not responsible for any aspect of sales between you and High St., including any injury, damage, or loss, and you release Shopify and its affiliates from all claims arising from your purchases and transactions with High St.

9.  Feedback.  If you send us ideas, suggestions, or reviews (“Feedback”), you grant us a perpetual, worldwide, royalty-free license to use it for any purpose, including commercially. You represent that you own the rights to your Feedback and that it won’t violate these Terms or any third party’s rights. We have no obligation to keep Feedback confidential, compensate you for it, or respond.

10.  Errors.  The Services may occasionally contain errors related to descriptions, pricing, promotions, or availability. We may correct errors and change or cancel orders (even after submission) if information is inaccurate, without prior notice.

11.  Prohibited uses.  You may use the Services for lawful purposes only. You may not use them to break any law; infringe intellectual property; harass or harm others; transmit false information or spam; impersonate anyone; upload malware; scrape or harvest data; or interfere with the security of the Services. We may suspend or terminate your access for any violation.

12.  Automated agents.  Any software agent that accesses the Services must identify itself as an agent in its user-agent string (e.g., “Agent/[name]”), must not conceal that it’s automated or circumvent CAPTCHAs or other controls, and must respond truthfully when asked whether it’s human or automated. We may limit or block agent access by technical means.

13.  Termination.  We may terminate your access to the Services at any time at our discretion, without notice. You remain liable for amounts due up to termination. Sections that by their nature should survive — including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — will continue to apply.

14. Disclaimer of warranties.

EXCEPT AS EXPRESSLY STATED, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.

15. Limitation of liability.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HIGH ST., ITS AFFILIATES, OR SHOPIFY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.

16. Indemnification.

You agree to indemnify and hold harmless High St., Shopify, and our affiliates, officers, employees, and agents from any claims, damages, liabilities, and reasonable attorneys’ fees arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

17.  General.  If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce any right isn’t a waiver of it. These Terms are the entire agreement between you and us. You may not assign these Terms without our consent; we may assign them freely. These Terms are governed by the laws of the State of Ohio, and you consent to jurisdiction in the state and federal courts located there.

18.  Changes.  We may update these Terms at any time by posting the revised version here. Material changes take effect as described in our notice. Continued use after changes means you accept them.
